General Terms and Conditions

1. Scope of Application

1.1 These General Terms and Conditions apply to all contracts between Marius Nitzbon Music Merch (hereinafter "Seller") and the customer (hereinafter "Buyer") concluded through this online shop. 1.2 The version of these terms valid at the time of ordering shall always apply.

2. Contract Formation

2.1 Product presentations in the online shop do not constitute a legally binding offer, but an invitation to place an order. 2.2 The buyer places a binding order by clicking the "Buy" button.

3. Prices and Payment Terms

3.1 All prices are in Euro including statutory VAT. 3.2 Payment methods are displayed during the payment process and are processed through Shopify Payments.

4. Delivery and Shipping Costs

4.1 Delivery is made to the delivery address specified by the buyer. 4.2 Shipping costs are displayed during the ordering process and are borne by the buyer, unless a specified minimum order value is reached. 4.3 Orders are processed within 1-2 business days (if items are in stock). Delivery times: Germany 3-5 days, Europe 7-10 days, Rest of World 10-21 days. Please allow up to 28 days for delivery in exceptional cases.

5. Right of Withdrawal

5.1 The buyer has a 14-day right of withdrawal. The period begins upon receipt of the goods. Contact must be made to the seller by email: label.waltersgarage@gmail.com 5.2 Withdrawal is only accepted for manufacturing defects or shipping damage. Items must be unused and in original packaging. 5.3 Sealed vinyl, CDs, and merchandise cannot be returned once opened. Signed items cannot be returned. 5.4 For digital content, the right of withdrawal expires as soon as the download has begun. 5.5 The buyer must contact the seller with photographic or audio evidence before returning any items.

6. Retention of Title

The delivered goods remain the property of the seller until full payment.

7. Limitation of Liability

The seller is liable without limitation for intent and gross negligence as well as under product liability law. For slight negligence, the seller is only liable for breach of essential contractual obligations.

8. Copyright

8.1 All digital content offered is protected by copyright. 8.2 The buyer acquires only a simple, non-transferable right of use for personal use with the purchase.

9. Data Protection

The privacy policy is part of these terms and conditions and can be viewed separately.

10. Final Provisions

10.1 German law applies excluding the UN Convention on Contracts for the International Sale of Goods. 10.2 Should individual provisions of these terms be invalid, this shall not affect the validity of the remaining provisions.
